Terms of Purchase
Price Confirmations and Binding Agreement: Once you have placed an order to buy or sell with Kingdom Talents, you have entered into a binding agreement. When ordering online, the price at which your order is submitted is NOT confirmed until you receive your invoice ‘the locked-in price’. You must ensure that your payment is dated within 24 hours and received by within five business days on orders under $5,000 and three business days on orders more than $5,000 to guarantee your price. Providing us with your credit card information is required to guarantee all orders.
Terms of Payment
Payment Options: Payment to Kingdom Talents must be provided using a credit card, bank wire, certified check, cashiers check, money orders or personal check. Credit card orders for any amounts are reviewed on an order by order basis. Large credit card orders may be subject to additional documentation or screening and are subject to our approval. Therefore, we recommend paying by one of the other methods on orders more than $2,500. We recommend paying by the following methods: Orders ranging from $50 to $2,500 are recommended to be paid via any option listed above and must be received within 5 business days. Orders ranging from $2,500.01 to $10,000 are recommended to be paid by bank wire, certified check, cashiers check, money orders or personal check and must be received within 5 business days. Orders ranging from $10,000.01 to $25,000 are recommended to be paid by bank wire, certified check or cashiers check and also must be received within 5 business days. Orders over $25,000.01 are recommended to be paid by bank wire and must be received within 3 business days.
Holding Period on cashiers checks, certified checks and personal checks: We hold all certified checks and cashier’s checks until the banks has deemed them “good funds.” Typically this takes 1-10 banking days. Personal checks will be held for 10 banking days. Kingdom Talents has no obligation to ship orders until payment has cleared as “Good Funds” by the bank. Direct bank wire is always recommended.
Payment Instructions: Payment instructions will be issued on the final page of your ordering process and again by email after you place your order. Payment must be dated within 24 hours of your order date. Kingdom Talents reserves the right to cancel orders that do not meet these requirements. We reserve the right to refuse or cancel any order deemed questionable or of significant risk to Kingdom Talents regardless of payment method and price confirmation.
Terms of Order Cancellation & Refund
Cancellation of Orders: Once you have submitted your order, AND received your invoice all prices are locked-in. It is not our intention to enter into buying and/or selling transactions, accepting the risks involved only to have them canceled. However, we realize rare situations occur where orders need to be canceled. Should you choose to cancel your order, you will be subject to a 10% cancellation fee. Cancellations may only be approved over the telephone. No future orders may be permitted until the cancellation fee is paid in full.
Refused Transactions: Kingdom Talents reserves the right to refuse or cancel an order for any reason or for no reason at all, regardless of payment method or price confirmation, including without limitation, for orders Kingdom Talents deems questionable or suspicious, for orders Kingdom Talents deems to be a significant risk, when the confirmed price is incorrect, for abrupt movements in the precious metals market, and/or when Kingdom Talents does not receive payment within the allotted time frame.
Kingdom Talents is not responsible for pricing or typographical errors and expressly reserves the right, in its sole and absolute discretion, to cancel any and all orders placed with respect to such items. In the event of a cancelled order Kingdom Talents will contact you directly with notification of the cancellation.
Lack of Payment: Your KT order may also be canceled if we do not receive payment within five (5) business days on orders under $5,000 and three (3) business days for orders over $5,000. Once you have placed an order with Kingdom Talents, you have entered into a binding agreement. Orders not paid for in this timeframe are also susceptible to a 10% cancellation fee.
Return policy: At Kingdom Talents products may be returned limited to three (3) days from the date on which the customer receives their items and notifies us, provided that the products are kept in their original packaging. We want our customers to be pleased with their purchases. If for any reason you have a problem, please feel free to call our offices and discuss it with us. We will always do our best to accommodate you. We do charge a 10% restocking fee on all items returned.
Terms of Delivery
All transactions are made from our office in South Carolina, shipping can be arranged for you.
Shipment of Your Items: Each package requires a signature upon delivery. Once the item(s) have been signed for the buyer assumes all risks.
Shipping Address: Orders will be shipped to the address in the customer’s KT account at the time the order was placed. Orders paid for by PayPal will be shipped to the listed PayPal address. If for any reason the address is incorrect or outdated, the buyer is responsible for any loss of or damage to the merchandise.
Terms of Investment Risk
Gain and Loss: All investments involve risk – precious metals are no exception. The value of a bullion round (ex.1-troy ounce of silver) is affected by many economic factors, including the current market price of bullion, the quality, current demand, and general market sentiment. Because silver bullion can go down as well as up in value, investing in this precious metal may not be suitable for everyone. Since all investments, including bullion, can decline in value, you should understand them well, and have adequate cash reserves and disposable income before considering a bullion investment. KT will not be held accountable in any way, for customer losses in the market.
Buyback Policy
It is not permitted by law for Kingdom Talents to guarantee a repurchase of the items sold by it, although we have historically made buy-sell markets in bullion and coins we offer. In light of the above, Kingdom Talents buyback policy should not be viewed as a guarantee and is subject to change without notice.
Phone calls and Privacy
Every act of communication via phone between Customer and Kingdom Talents is subject to monitoring and/or recording. Customer calls with any Kingdom Talents representative are monitored and/or recorded without further notice or the requirement of additional consent or agreement from Customer. Monitoring and/or recording of Customer telephone conversations with any Kingdom Talents representative is performed by appropriate Kingdom Talents personnel and authorized outside third-party monitors. Unless otherwise agreed by Kingdom Talents in a written form, Kingdom Talents does not consent to the recording of telephone conversations by Customer or any third-party. Customer understands that not all calls are recorded and not all recordings of any particular telephone calls will be retained or capable of being retrieved by Kingdom Talents.
Indemnification
Kingdom Talents is not liable for any loss or damage, whether direct or indirect, resulting from the transactions contemplated by these Terms and Conditions.
Kingdom Talents is not liable under any circumstances for special, incidental, consequential, indirect or punitive losses or damages (including lost profits or lost savings), whether or not caused by the fault or neglect of Kingdom Talents and whether or not Kingdom Talents had knowledge that such losses or damages might be incurred.
The limitations and exclusions apply to all claims of whatsoever nature, kind and description, whether arising from breach of contract, delay or non-delivery of services, negligence or otherwise.
Force Majeure
Kingdom Talents is not liable for any failure to perform its obligations due to fire, computer viruses, network failure, computer hardware failure, explosion, flood, lightning, act of terrorism, war, rebellion, riot, sabotage, orders or requests of any government or any other authority, legislative changes, strikes, lockouts or other labor disputes, or events or circumstances beyond its reasonable control. However, Kingdom Talents shall use commercially reasonable endeavors to minimize dangers or losses as a consequence of such events.
Changes to Terms and Conditions
Kingdom Talents reserves the right to amend these Terms and Conditions, any applicable fees and charges, or any services, rights or obligations provided for herein at its sole discretion, at any time, without prior notice to the Customer. Acceptance of these Terms and Conditions is limited to the acknowledged transaction and is not applicable to any future transactions. The Terms and Conditions are to be accepted by the Customer for every subsequent transaction.
Applicable Law
This Agreement is construed in accordance with and governed by the laws applicable in the State of South Carolina.
Severability
In the event that any provision in this Agreement is determined to be invalid, illegal, or unenforceable, such determination shall not affect the validity and enforceability of any other remaining provisions of this Agreement.
Affiliate Terms and conditions
I Commissions
- Commissions are paid only to the Referrer that is Active. Referrer is considered to be active if he/she have brought at least one (1) new client to the Company in 6 months.
- It is a condition of this Agreement, and the parties hereby agree, that Commissions shall not be deemed to have been earned by the Referrer until the invoice has been paid by the customer.
- The Referrer will receive a check with a commission if his commission amount is over $10.00. If the commission amount is less than $10.00, the Referrer will receive only a monthly statement, without a physical check. Referrer’s commission will be accumulated and the check mailed to the Referrer when the amount of accumulated commission exceeds $10.00.
- Commissions vary according to quantities, market volatility, and negotiating to make a deal.
- Referrer receives commissions only for the new customers that he/she brought in. If a person is/was already an existing customer of the Company, the Referrer will not receive any commission from that sale.
- Referrer who lives on the HIM property is not authorized to market to or generate customers from the people living on the HIM property and members of the MorningStar church, as they are considered Company’s customers and commissions are not paid on sales to them.
- Commissions will be paid in the month following.
- Commissions are payable to the Referrer that has brought the sale in.
- For the sales made online, commission is paid to the Referrer whose name is indicated by the client while filling out the client’s information.
- The Referrer, whilst active, gets commissions from any further purchases by that client, unless the client specifies that he/she is working with another Referrer.
II Discounts
- Referrer is qualified to receive discounts from the Company on his/her personal purchases.
IV Usage of Graphics and Advertisement
- All graphics and advertisements used by the Referrer need to be approved by the Company. No usage of any unapproved materials is permitted. Approved materials are available.
